Due Diligence Before Buying a Villa in Bali: Documents, Notary, Land Status
Buying a villa in Bali always starts with legal due diligence. Without this step, the risk of losing money or ending up with invalid rights far exceeds the cost of the verification itself. Bali has no unified property registry like Russia, so every document must be verified individually and in combination with others.
What the Notary (PPAT) Checks
In Bali, the transaction is handled by a notary (PPAT — Pegawai Pembuat Akta Tanah). Their job is to prepare the deed of transfer (Akta Jual Beli) and verify the seller's right to sell. The standard PPAT verification package includes:
- Sertifikat Hak Milik (SHM) or Sertifikat Hak Guna Bangunan (SHGB) — freehold title or building rights title. The original must be with the seller; the copy is cross-checked against the BPN (National Land Agency) archive.
- Surat Ukur Tanah — land survey map with boundaries, signed by a licensed géomètre. The map is compared with actual fences and neighbouring plots.
- NJOP (Nilai Jual Objek Pajak) — cadastral value for tax calculation. It is below market value but affects BPHTB (acquisition tax) and PPh (seller's income tax).
- SPPT PBB — land tax payment receipts for recent years. Unpaid taxes transfer to the buyer.
- Seller's KTP and KK — ID card and family card. For foreigners — KITAS/KITAP and passport.
- Izin Mendirikan Bangunan (IMB) / PBG — building permit. Without it, the villa is an illegal structure.
- Sertifikat Laik Fungsi (SLF) — certificate of fitness for use. Issued after building completion, confirms the building matches the approved plan.
Land Status Check: Leasehold vs Freehold
This is the single most critical point. Foreigners cannot own land in freehold (Hak Milik) — this right is reserved for Indonesian citizens (WNI). Options for foreigners (WNA):

Important: many agencies sell "freehold via nominee" (Indonesian nominee holder). This works until it doesn't — legally, the nominee can revoke rights at any time. Balila does not recommend this scheme without separate legal counsel and full risk awareness.
Why You Need a Géomètre (Licensed Surveyor)
A géomètre visits the plot and performs:
- Pengukuran Lapangan — field measurement of actual boundaries, area, corner coordinates.
- Comparison with Surat Ukur — discrepancies between paper and reality (often 10–50 cm, sometimes metres).
- Zoning check — whether the plot's zoning (RLTR / RTRW) allows a villa, hotel, or commercial use.
- Access verification — whether legal access to the plot exists and isn't over a neighbour's land.
The result is a surveyor-signed, stamped plan. Without it, the PPAT will not issue the deed, and you won't know if your fence sits on someone else's land.
Additional Checks (Outside Standard PPAT Scope)
PPAT only verifies "paper" legality. Risks it does not cover:
- Neighbour disputes — boundaries, access, drainage. Resolved only via neighbour interviews and court database (Mahkamah Agung) search.
- Mortgages and encumbrances — request Sketsa Hak Tanggungan (encumbrance list) from BPN. If land is mortgaged, the deal requires bank consent.
- Inheritance disputes — if the seller inherited, you need surat keterangan waris (heir certificate) and consent from all heirs.
- Commercial viability — if you plan short-term rental (homestay/hotel), you need a Pondok Wisata or Hotel Melati licence. Without it, rental income is illegal.
- Utilities — electricity (PLN), water (PDAM/well), internet, sewage. Connection costs are separate and not always feasible.
Buying Process Through Balila
- Pre-DD (preliminary due diligence) — we request document copies from the seller, run our checklist, give green/red light in 2–3 days.
- Booking fee — 10–20% of price, secures the property during full DD. Refunded if DD reveals deal-breakers.
- Full due diligence — géomètre on site, BPN request, court database, tax check, neighbour interviews. 7–14 days.
- Negotiation on findings — if issues found (missing SLF, tax arrears, boundary mismatch), we negotiate fixes at seller's cost or a price reduction.
- Signing Akta Jual Beli at PPAT — completion day. Balance payment, key handover, BPN registration (2–4 weeks).
- Post-completion — help with utility transfers, insurance, staff hiring.
Common Buyer Mistakes
- Skipping the géomètre — "documents look fine, why pay". Later discover the plot is 15% smaller or the fence encroaches.
- Trusting "freehold via nominee" without side agreements — risk of losing the entire asset in a nominee dispute.
- Ignoring zoning — buying in a green belt (tanah hijau) or airport zone where construction is prohibited.
- Overlooking seller's taxes — PPh 2.5% and BPHTB 5% must be paid before registration. Seller's tax debt becomes your problem.
